Abstract

Nowadays, due to changes in social conditions and rapid social and technical development, the law is more demanding to create, apply and interpret. Private law in the Member States is increasingly open to Europeanization and constitutionalization. In the present article the author deals with the question of how European and constitutional law (including fundamental rights and freedoms) interfere with private law in the Slovak republic. The author explores how European and constitutional values and principles influence interpretation of the norms of private law. In present article the author draws attention to ad hoc legislation introduced as a result of the supposed enforcement of the law of the Union, which may have constitutional implications.
