Abstract

This chapter analyzes (on the basis of selected examples) the impact of Article 18 of the Polish Constitution on the Europeanization of Polish family law (“Marriage as a union between a man and a woman, family, motherhood and parenthood are under the protection and care of the Republic of Poland.”). As a result of carrying out the analysis, the author formulates the thesis that the wording of this regulation has the effect of blocking the influence of the law of the European Union and other Member States on Polish family law legislation. However, the author also notes that the legislator has normative grounds to protect the national principles of the legal order, especially in the absence of the European Union’s competence to create substantive law in this regard.
