Abstract

Writing in 1939, Carl Schmitt declared the coming âdawn of the concept of the Reichâ in the law of nations, meant to reflect both the rise of National Socialism in Germany and Germanyâs formation of a GroÃdeutsches Reich in Europe. Using the lens of Schmittâs concept of historicity, this chapter reconstructs three aspects of Schmittâs thought on empire and Reich and international politics in the pivotal years between 1938 and 1941: first, Schmittâs rejection of the state as an essentially foreign and subversive concept for German political aspirations, one that would be overcome by a âsuperiorâ German concept â second, the concept of empire and imperialism as an Anglo-American strategy for asserting indirect and economic forms of control over other states â and third, the concept of the Reich as a new ordering principle for Europe based on political leadership, or âFÃ¼hrungâ. In the process, this chapter illuminates Schmittâs twin strategy of historicization and weaponization of legal concepts for waging ideological warfare in the present.
