In recent years the concern about food waste has grown in the EU. In accordance with official data, almost half of the world’s food is thrown away. It has been said that if nothing is done, food waste in the EU is expected to rise to about 126 million tons by 2020. The European policy target is to reduce food waste by 50% by 2030 and institutions and actors in the food chain are considering different measures to achieve it. In this paper we analyze the ethical and legal aspects of some proposals that currently promote the donation of leftover food in ways that do not match the current EU and member state’s legislations. In other words, we focus on some proposals that would involve changing the EU members’ legislation and practices on food donation. Among others, we will reflect on the so called ‘Food banking solution to food waste and hunger’ proposal, which involves reducing legal barriers to food donation, following the model of the ‘Good Samaritan laws’ of other countries (like the USA) and giving supportive tax benefits to the potential donors. We think that some of the premises behind the above mentioned proposal are controversial and there are some relevant facts that have not been taken into account by its design.
