This article attempts to analyse the role of the new paradigm represented by market constitutionalism and its fundamental principles, in the Common Agricultural Policy (CAP). Initially, the CAP was characterized by a kind of government intervention targeted at guaranteeing protected development of the agricultural sector against external competition, a more productive agriculture, while providing a reasonable standard of living for EU farmers. Nonetheless, the new basis of the Economic Constitution speculates on the community area and located in the autonomy of the market re-proposes its configuration in other terms. Moving away now from the parameters that have defined the institutionalization as well as the development of the CAP, some steps have just been taken according to the new paradigm, such as the consecutive CAP reforms or the political agreement reached by the agriculture ministers on 20 November 2008, known as ‘Health Check.’ All of these regulatory and political bases mentioned above, place the CAP in the way of promoting ‘sustainable agriculture in a global environment.’ Reinforcing a competitive and innovative agricultural sector that can respond to the challenges of the world market under the rules of a highly competitive social market economy, the new European policy paradigm seems to seek to balance competitive agriculture with social cohesion in a connection in which the second element is irreversibly bound to assume a subordinate position.
