Abstract

Civil society organisations, human rights defenders and others have called for mandatory measures on business respect for human rights for decades. A few countries in Europe have led the way by introducing mandatory human rights due diligence legislation. Now, the European Union (EU) is in the process of developing a far-reaching regulatory framework on corporate sustainability that includes various initiatives which regulate business impacts on human rights. By implementing international standards such as the United Nations (UN) Guiding Principles on Business and Human Rights through this suite of legal and regulatory initiatives, the EU is treading new ground by developing a gradually expanding regulatory ecosystem with mutually complementary initiatives implementing different elements of international standards on business and human rights. While this development is eagerly awaited and welcomed by many, it also brings about new challenges as soft-law expectations of the key international frameworks are translated into legislation. These include challenges with respect to policy coherence across regulations, effectively capturing key design features of the soft-law standards and ultimately successfully crafting legislation that will have its intended effect on people. This contribution takes stock of the human rights elements of select EU initiatives such as the Corporate Sustainability Due Diligence Directive and the Corporate Sustainability Reporting Directive and explores the challenges of effectively addressing business infringements on human rights within and across the regulatory initiatives. It argues that while legalisation is key to scaling up respect for human rights, there is a need to maintain and actively work to ensure a conducive interplay between soft- and hard-law instruments on business and human rights.
