Abstract

In 2022, the EU’s Temporary Protection Directive was activated for the first time after Russia had launched a war of aggression against Ukraine. Displaced persons were thus granted ‘temporary protection’ in the MS of the EU. Although the activation was widely welcomed by advocates of protection seekers, relevant organisations and academia, concerns were raised that the Temporary Protection Directive could be misused to circumvent the application of the 1951 Refugee Convention. The examination of such a derogation requires a general discussion of the legitimacy of derogations under the 1951 Refugee Convention – an aspect of International Refugee Law little research has been done on. Thus, this contribution discusses the legitimacy of derogations under the 1951 Refugee Convention as well as the alleged danger stemming from the Temporary Protection Directive to replace it or to block access to asylum procedures. It argues that, though the question of derogation in International Refugee Law will require further discussion in academia, the 1951 Refugee Convention contains a provision that could be considered an ‘imperfect derogation clause’ of uncertain quality. Regarding the Temporary Protection Directive’s derogative potential, this contribution claims that it does not pose a risk to replace the established refugee protection regime but, nevertheless, impedes access to asylum procedures due to the temporal suspension of asylum claims. It is argued that such a measure can be justified for the sake of a functioning temporary protection framework.
