Abstract

This article examines the implications of three advisory opinions from international courts – the International Tribunal for the Law of the Sea (ITLOS), the Inter-American Court of Human Rights (IACtHR) and the International Court of Justice (ICJ) – addressing States’ obligations in relation to climate change. These opinions emerge from coordinated strategic efforts by small island States, supported by civil society organisations, to clarify international obligations in the Anthropocene. Although advisory opinions are non-binding, they wield significant normative influence, potentially framing future litigation and redefining inter-institutional authority in the fragmented regime complex of climate governance. Drawing on theories of institutional authority and regime complexity, the article posits that these advisory opinions serve as forums for strategic claims to institutional authority, inviting competition and cooperation among international courts for future litigation. The article identifies four key narratives about climate change obligations emerging across the three proceedings: climate change as a justice issue emphasising global inequality; a human rights-centered approach highlighting impacts on vulnerable groups; an integrationist approach advocating holistic legal interpretation across regimes; and a politics-first approach prioritising non-legal frameworks. The ITLOS opinion, the first issued so far, adopted a cautiously integrationist approach, affirming the interplay between UNCLOS and climate treaties while avoiding explicit human rights or equity considerations. The article explores how these opinions will shape the dynamics of future strategic litigation, and inter-institutional competition for such litigation. It concludes that the interplay of diverse narratives, participants, and interpretive methodologies in these advisory opinions will significantly influence the development of international climate law and governance.
