Abstract

The emergence of international investment law (“IIL”) has elicited extensive criticism, particularly from Third World Approaches to International Law (“TWAIL”) scholars, whose aim is to highlight the inequities experienced by developing nations within the international legal framework. I critically assess TWAIL’s effectiveness in evaluating IIL, revealing its shortcomings in addressing the specific challenges faced by Indigenous peoples and other marginalised groups. These shortcomings mean that, while TWAIL has made significant strides in spotlighting the vulnerabilities of Third World states and proposes admirable measures to address such vulnerabilities, it falls short in offering more targeted solutions to where the excesses of IIL are felt most acutely. This analysis underscores the need for a shift toward more precise and inclusive critiques. Ultimately, this paper challenges the prevailing reliance on TWAIL as a principal critique of IIL, questions its broader applicability as a favoured critique of international law, and advocates for more nuanced and comprehensive analyses in an increasingly complex international legal landscape.
