The chapter explores the prospective application of the press publishers’ right introduced by Article 15 of the CDSM Directive in relation to the existing national copyright exceptions and limitations. Although the new neighboring right is a mechanism designed with a very specific purpose in mind, it covers all information society service providers, which include online newspapers themselves. It also has an ambiguously defined subject matter that might hinder the free dissemination of news and thus jeopardize the exercise of freedom of information and freedom of the press. The legal fragmentation regarding permitted uses of copyrighted works on the European Union level is well documented. However, this issue is even more pronounced when exceptions to neighboring rights are concerned. EU Member States have adopted different approaches to the application of existing copyright exceptions to neighboring rights. The chapter focuses on the legislative techniques used by different EU countries to regulate permitted uses of subject matter protected by neighboring rights and the way these different approaches could affect the scope of the national implementations of Article 15.
