In this chapter, I seek to contribute historical perspective on the ideal of “harmonization” in international law, with brief reference to the significance of that ideal for intellectual property law. I trace the ideal of legal harmony from Platonic harmonia (symphonia) to Roman concordia, lingering, with the help of Weberian social theory, on the ideal-typical features of a simultaneously religious and political model of legal rationality carried from Solon of Athens (Sixth Century BC) to Tribonian and Justinian (Sixth Century AD), then onward into the modern age of social science and international law. Reminding ourselves that the metaphor of legal harmony has ancient and medieval roots can, I believe, help us to understand more contemporary challenges from the Twentieth Century, when organizations like the European Economic Community and the World Intellectual Property Organization (WIPO) were created to carry and pursue it. What deserves renewed consideration is the extent to which the modern ideal remains profoundly social and political, with overtly religious dimensions, even while it appears to be primarily technical, legal, and economic.
