Abstract

The jurisprudence of the CJUE has been at the forefront of regulating lender-borrower relationships flowing from foreign currency loans. This Chapter demonstrates how the CJUE gave concrete shape to questions emerging from this type of loan contracts by offering an interpretation of the key provisions of Directive 93/13/EEC on unfair terms in a consumer contract. The Chapter advances the claim that the development of a comprehensive regime applicable to a foreign currency loan contract will constitute an important legacy of CJUE jurisprudence of the last decade.
