Abstract

Several regularities were present in the process of creation and the resulting post-backlash human rights law. Based on the analysis of the three post-backlash human rights norms, I have termed them “techniques”. The first is titled “silencing the voices” and describes the tendency of the international human rights community not to listen to the backlash justifications invoked by the states. This was done on the basis of categorizing the states as authoritarian and consequently delegitimizing their arguments and categorizing their arguments as either non-legal or not in conformity with international human rights law. I have subsequently analyzed some of the “silent arguments” – the sovereign equality of states and non-interference in domestic affairs, the dignity of a state, colonialism, and economic development. The analysis has not revealed a distinctive feature that would make these arguments non-answerable. On the contrary, some of the arguments raised are vital for the political, legal, and historical contexts of the opposing states. The second mechanism employed by the international human rights community – “humanizing the law”, describes their tendency to justify the creation of post-backlash law with reference to the narrative of humanity – the protection of the individual, of people, of humanity, a victim, and higher values. These two steps have led to the third mechanism – “recreation of the self”. It refers to the tendency of the international human rights community to give more legal power to itself. Finally, perspectivism has revealed the environment of internal crisis that has shaped post-backlash law. It has created an enhanced level of solidarity among the agents of norm internalization, greater polarization between them and the state, a firmer belief in their own set of values, and less self-reflexivity on the part of the global human rights community.
