Abstract

In the second case study, I center on the right to receive foreign funding as part of the right to freedom of association. The type of backlash in the background targets civil society, the so-called “closing space” phenomenon. Numerous, mainly Third World states, have called into question the alleged political activities of civil society actors. In order to keep their domestic politics free from foreign interference, they have enacted legislation that claims to target civil society actors funded by foreign sources and working on domestic politics. International NGOs and other agents of norm internalization, among others, have used the tool of international law to preserve their civic space. One of many initiatives was the initiation of the process of creation of another post-backlash human rights norm – the right to foreign funding for civil society from any donor and for any activity. This process was initiated by the 2013 UN Report of the Special Rapporteur on the Rights of Freedom of Peaceful Assembly and of Association. The Report introduces unhindered funding for civil society from any donor and for any activity. It further advocates for responsibility to donors. This case study focuses on the legal narratives present before and on the occasion of adopting the 2013 Report.
