Abstract

This chapter examines the political economy of the demand-side policy of financial aid programs adopted by the U.S. federal government in order to improve access to higher education. Although this policy has greatly improved access in a relatively short time period, there has been an important undesirable side-effect of excessive student indebtedness. When for-profit universities equally took advantage of such programs, the problem became more serious, as growing government expenditure was channeled to private investors at the expense of taxpayers. The Obama administration adapted several policies, including gainful employment (GE) regulations that limited some institutions’ ability to qualify for the federal student aid program when graduates’ indebtedness exceeded a certain point. The GE regulation has been challenged vigorously by for-profit universities and the Republican Congress. After long administrative delays and court battles, a compromise regulation was promulgated at the end of the Obama administration, making a substantially adverse―but not catastrophic―impact on the for-profit university sector. However, the succeeding Trump administration has revoked much of the Obama-era regulations. This flip-flopping of federal regulations has generated further confusion among education stakeholders and vigorous contest among interest groups.
