Abstract

The sovereignty issue in the Wimbledon case was connected with a possible justification of the failure to fulfill Germany’s obligations under the Treaty of Versailles by invoking a declaration of neutrality and German domestic law. The question required the PCIJ to consider the importance of State sovereignty for the State’s international obligations. The Court stated that it is neither absolute nor unlimited, and its limits are defined by international law. Sovereignty was reflected in one of the most frequently cited passages of the judgment, according to which the conclusion of an international agreement cannot be considered as a limitation of State sovereignty, but on the contrary – it is an expression of this sovereignty. This idea was frequently presented by authors contemporary to the Wimbledon judgement. The statement by the Court was subsequently developed in the Lotus case. The author argues that it remains relevant to international law in present times.
