Abstract

The Chapter is devoted to the historical and legal context of the Wimbledon judgment, that is the Versailles Treaty and its reception in Germany and Poland. This chapter provides guidance for a clearer examination of the context surrounding the dispute decided by the PCIJ and of the legal statements of the parties submitted before the Court. The interpretation of rights and obligations following from the Versailles Treaty had been crucial both for the Court and for applicants and respondent, which was clearly noticeable during the proceedings. The judgment is of particular importance not only because it was the first judgement of the PCIJ that inevitably led to a positioning of the Court in international law. It was also the first international judgement based on the Treaty of Versailles, thus rendering the Treaty itself – even if only indirectly – the subject of proceedings.
