Abstract

This chapter argues that the limitations and challenges to the application of customary law in Botswana are key determinants of the nature of customary law applicable in the country. Highlighting these challenges, as discernible from pre-independence and current laws, the chapter illustrates that these limitations and challenges have not only influenced the extent to which customary law is applicable but have also greatly influenced the nature and content of customary law in Botswana. Concomitantly, the chapter argues, customary law is being relegated, if it has not already, into a system of law that is undermined by the common law and statutory laws.
