Abstract

In 2020, China promulgated changes in its national law resulting in the rescission of the autonomy of Hong Kong. International law ordinarily has little to say about the manner in which a country administers its territory. Although China has sovereignty over Hong Kong, it administers that territory under a settlement obliging the maintenance of Hong Kong’s autonomy until 2047. China entered the settlement under international law, including the autonomy provisions contained in the settlement. The recent changes in national law, therefore, are in breach of international legal obligations of China. The present article considers the legal basis of Hong Kong’s autonomy, the national law by which China has rescinded Hong Kong’s autonomy, and legal rights violated by the recission of Hong Kong’s autonomy.
