Abstract

The Asia-Pacific region has struggled to address the issue of cruise vessels during the COVID-19 pandemic. For example, when the Diamond Princess arrived at Yokohama Port (Japan), 712 people on the vessel were found to be infected by the virus. Such experiences demonstrate the ambiguity of current frameworks for internal waters. Coastal States have struggled to decide what measures should (or should not) be taken in accordance with international law when a cruise vessel with COVID-19 patients arrives on their shores. Against this background, this article outlines a suitable new framework to address situations when infectious diseases occur onboard trans-border cruise vessels. For this purpose, the article first describes the current framework, primarily focusing on the rights and obligations of coastal states over their internal waters, and clarifies the challenges of the existing frameworks. Then, it proposes a new framework for cruise vessels affected by infectious diseases from the perspective of the law of the sea.
