Environmental justice has both an intragenerational and an intergenerational perspective. Much effort has been made in order to provide for a more just international legal order, especially in the field of the redistribution of profits and burdens that stem from the use of natural resources within the currently living generations. The access to natural resources links the environmental and economic interests of those living today with those who will live in the future. Intergenerational equity is not so commonly recognized, although there are both theoretical and practical reasons for that. There are important national and international legal acts that mention the need to protect the rights of future generations. The approaches the need of protecting the rights of future people differ from attempts to consider the rights of future people, in a similar way to human rights, to the attitude that does not give any legal meaning to legal statements which mention about such need. Hungary, Israel and some other countries, have attempted to introduce the institutions aiming at the protection of future generations. In other countries, future generations’ interests are being recognized by the Supreme Court’s rulings. The Rio 20+ Conference agenda included some institutional arrangements in this field, but a consensus was not reached over the guardianship for future generations; thus, the future perspectives of the concept remain unclear. Future generations’ rights and entitlements are especially important in the field of environmental resources. Even if we decline to give full protection to the rights of future generations, we can still use intergenerational equity as a standard for the protection of the environment and the efficiency of existing rules. Furthermore, intragenerational equity is an element of the principle of sustainable development, which is one of the fundamentals of international legal order, especially in the field of international economic law and international environmental law.
