Abstract

The European Union (EU) lodged a formal complaint with the World Trade Organization (WTO) over Taiwan’s local content requirements (LCR s) in the offshore wind sector in July 2024 – Chinese Taipei – Measure Relating to Investments in Offshore Wind Installations (Chinese Taipei—Offshore Wind Installations (EU). An amicable solution was reached in November 2024 with Taiwan’s commitment to remove LCR s in its future offshore wind allocation rounds, either as eligibility conditions or as award criteria. As the latest addition to an ever-expanding list of WTO renewable energy cases, Chinese Taipei—Offshore Wind Installations (EU) occurred amid a time when the interface between low-carbon transition, energy security, and green industrialization has been more complex than ever. Taiwan’s attempt to pursue multiple policy objectives with the LCR s in the offshore wind sector, which may appear politically appealing, has encountered mounting challenges. Amid a time when protectionism is on the rise, the positive role of the WTO rules in ensuring fair competition and economic efficiency, while easily overlooked, should be upheld. It is essential for Taiwan to achieve the multiple goals of energy security, carbon neutrality, and industrial competitiveness in the offshore wind sector without compromising its WTO obligations.
