Abstract

Sahrawi self-determination in Western Sahara requires new impetus. Since self-determination cannot be exercised, at least currently, on the physical territory of Western Sahara, this chapter explores the possibilities for digital self-determination of the Sahrawi people. Digital self-determination forms a framework for the realisation of the right of peoples to self-determination in international law by relying on newly developing technologies, such as digital twins, ai algorithms and blockchain. The chapter assesses whether digital self-determination is a suitable option for the Sahrawi people, as well as how it could aid minurso in conducting the long-awaited referendum on the future status of Western Sahara. Furthermore, given the latest rulings of the Court of Justice of the European Union on Western Sahara, existing treaty frameworks between the EU and Morocco are examined for their aptness to facilitate the promotion by the EU of digital self-determination of the Sahrawi people. Relying on the EU–Morocco Association Agreement (2000), it is submitted that the failure of Morocco to respect Sahrawi (digital) self-determination can be regarded as a material breach of the Agreement by the EU, leading to a possible suspension or termination of the Association Agreement, or to countermeasures imposed by the EU against Morocco.
