Abstract

This chapter covers the main traits and difficulties faced by Japanâs administrative environmental tribunals, with an emphasis on the Environmental Dispute Coordination Commission (EDCC) operations. Prior to the creation of the Pollution Dispute Settlement System, trials in regular courts were used in Japan to settle Kogai (environmental pollution) issues. Since its founding 50 years ago, the EDCC has adjusted adaptably to the times. The EDCCâs handling of environmental issues has frequently drawn attention from the public and, from the standpoint of law policy, had a considerable influence on Japanese society. In this regard, it is possible to say that the EDCCâs efforts have produced positive results and faced many challenges. This chapter highlights the possible causes of this situation, problems of pollution dispute resolution, and the need to reform Japanâs administrative environmental tribunals.
