Abstract

Space activities are the product of scientific and technological innovation, and an unquenchable thirst for human adventure, military security, commercial opportunity, and the presence of effective international and domestic legal regimes. All are substantially influenced by world public opinion. The latter has manifested itself in many environmentally orientated forums, not the least of which, and only the most recent, was the 1992 United Nations Conference on the Environment and Development. The reasonable expectations of this Conference have singular relevance to space debris and to the power sources of space objects.

The world space community has long been aware of the pollutional and contaminational aspects of space activities. This awareness has resulted principally because of the dangers presented by the ever-increasing amount of solid debris in orbit, the harmful consequences of the effluent resulting from the use of solid rock fuels for space launches, and the employment of two types of nuclear fuels (one relatively benign and the other dangerous) by space objects.

Policy makers have been confronted with several choices â to prohibit different fuel sources or to allow such fuels to be used subject to intelligent and practical restrictions, while offering an inducement to users to proceed with great caution. This inducement, which also applies to those who produce debris, is in the form of monetary damages payable to those who have suffered detriment. Associated with this sanction is the presence, now, of a special requirement that notice be provided to those who may possibly be harmed by debris or damage- producing nuclear events.

A dramatic, positive step concerning the protection of the outer space environment occurred on December 14, 1992, with the United Nations General Assemblyâs adoption, without a vote, of Resolution A/47/20 entitled âPrinciples Relevant to the Use of Nuclear Power Sources in Outer Spaceâ.
