A heterogeneous regulatory space has been created at EC level in relation to illicit drugs. The author argues that the acquis communautaire, in areas as diverse as the four freedoms, agriculture, the approximation of laws, has had a direct and profound effect on the Member States. Common systems have been created, and common approaches adopted, leading to a veritable ‘economic policing’ of drugs. In other areas covered by the EC Treaty, such as social provisions, public health and external policy, the impact has not been so pronounced, although the potential exists for more EC intervention. After examining the relevant changes in the Draft Treaty of Amsterdam, the author concludes that the impact of EC law on national extra-penal regulation of illicit drugs is bound to increase when the Treaty enters into force.
