Abstract

Compliance with judgments of the European Court of Human rights (ECtHR), as a fundamental pillar of the Council of Europe’s work, has become a deepening challenge to the effectiveness of the system. In the last decade, the problem of non-compliance, often materializing in cases of minimalistic, delayed or even contested compliance, indicates states’ insufficient efforts to fully comply with the Court’s legally binding judgments posing a systemic problem across Europe. Of the ‘leading’ judgments handed down by the ECtHR in the last ten years – i.e. judgments identifying structural or systemic problems – 47%, or 1300 judgments, remain pending implementation. A growing number of ECtHR judgments identifying ‘bad faith’ in the way in which states have restricted human rights in the last few years is a further worrying testimony to this challenge. It is known that among the states with highest numbers of such unimplemented cases are primarily those that joined the CoE as newly emerged states following the end of the Cold War, with weak legal, political and social systems, however, what is less understood is how such states implement ECtHR judgments (to the extent that they do) and why they act as they act. The book aims to address this gap by exploring compliance with ECtHR judgments in less researched states on the spectrum of democratisation, varying from democratising to increasingly authoritarian tendencies: Armenia, Azerbaijan and Georgia. It offers insights into the complex domestic contexts within which implementation takes place identifying the various factors and motivations that explain the states’ complex compliance performance.

On the basis of these findings, the book argues that the concept of partial compliance and its various forms deserve enhanced attention both in the academic literature and the international human rights community. It strongly suggests that compliance should no longer be seen as a binary phenomenon and that it is necessary to pay greater attention to prevalence of partial compliance. Finally, in light of the growing academic and the CoE interest in the impact of the Convention norms in recent years, the book explores the wider impact that ECtHR judgments have beyond formal compliance as a significant contribution to the conceptualisation of impact in the context of the international human rights law.
