Abstract

Constitutional history can be a valuable tool for building a constitutional identity. The disputed nature of the Brazilian constitution’s founding is a constant impediment to the consolidation of its constitutional system. This chapter analyses precedents in which the Brazilian Supreme Court, known as the Supremo Tribunal Federal, has attempted to deal with the legacy of the constitution’s foundation and determines that the Court has shown itself unwilling and unable to resolve the tensions between existing foundational narratives. This inability, in turn, has undermined the legitimacy of its decisions and its reputation as an institutional player charged with furthering the consolidation of the constitutional system. Brazil needs to reset the debate on its constitutional narrative and identity, and the Supreme Court will therefore have to take a stand regarding the tension between existing constitutional narratives and establish the provisional dominance of one particular historical reading, which will provide a basis for future disputes.
