Abstract

1A juridical approach to education as a human right raises a preliminary challenge: How to introduce it into the theorisation of the educational phenomenon?
2Education is ultimately a form of power. Well, every power of human beings over human beings raises the question of its legitimacy.
3The question of the legitimacy of education is that of the foundation, sense and control of the power it exerts through the contents and forms of the communication it accomplishes. It amounts to determining the very criterion of the pedagogic that is the traditional signifier of all validity claims concerning education. All in all, it is a matter of answering the following bold question: By what right to educate? This is the meta-question of education insofar as it underlies and overdetermines the subsequent ones.
4Education having been elevated to the human right status – the highest one of the contemporary ethical-juridical normativity – the most legitimate response to the meta-question of its legitimacy should be researched in the right to education.
5In order to grasp the revolutionary novelty of the right to education, we need first to understand the revolutionary significance of human rights and, in particular, of the rights of the child.
