This chapter revisits pre-colonial and colonial Philippines, as it expatiates on the emergence of the two most important precepts in indigenous land rights discourse: the Regalian doctrine on the one hand, and the Cariño doctrine on the other. It demonstrates the progressions and regressions of State policies on the “natives” during the Spanish and American colonial regimes, and until prior to the 1987 Constitution.
