Abstract

Article 54 of the Law of Treaties, refers to the operation of a treaty in regard to all the parties or to a particular party may be suspended: (a) in conformity with the provisions of the treaty; or (b) at any time by consent of all the parties after consultation with the other contracting States. The parties may resort to suspension, for instance, if they temporarily encounter difficulties concerning the performance of their obligations under the treaty. Thus, the suspension may occur in conformity with the provisions of the treaty, or at any time by consent of all the parties after consultation with the other contracting States. The attraction of a treaty's suspension as in Article 57 is that it appears less radical and provides more flexibility than the termination of a treaty.
