Abstract

In today’s rapidly evolving global landscape, marginalized communities face intensified crises due to climate change, conflict and economic disparity. Innovative uses of technology, coupled with the equitable transfer of Intellectual Property Rights can play a pivotal role in empowering these communities and ensuring their fundamental human rights. This paper explores strategic approaches that integrate technology and Intellectual Property transfer to address the unique challenges faced by marginalized groups, focusing on global frameworks like the TRIPS Agreement and its flexibilities, such as compulsory licensing, which have allowed countries to access critical technologies during crisis-like situations (Correa, 2019). Current international agreements, including the UN Sustainable Development Goals (SDG s) emphasize technology’s role in achieving social equity. Yet there remain significant gaps in ensuring that marginalized communities can benefit from these advancements. Judgements such as the South Africa case on access to life-saving HIV medication highlight the ongoing tensions between IP protections and human rights obligations. The objective of this paper is to identify grey areas in the current IP and technology transfer landscape, focusing on barriers to accessibility and innovation. By reviewing case studies and international rulings, this paper proposes policy recommendations aimed at fostering inclusive technology strategies. The anticipated outcome is a set of actionable solutions that ensure marginalized groups not only survive crises but are equipped with tools for long-term resilience and empowerment.
