Abstract

In Taiwan, there are currently three laws that specifically address sexual harassment: the Act of Gender Equality in Employment, the Act of Gender Equality in Education, and the Act of Sexual Harassment Prevention. These regulations require employers and schools to establish prevention mechanisms and complaint channels, and hold violators administratively and criminally liable. However, according to statistics from the Ministry of Labour, every year about 250,000 workers are victimised, but nearly 80% of them choose not to complain. The main reasons why victims are reluctant to report include fear of retaliation or concern about the impact on the work environment, as well as the sudden nature of sexual harassment, making evidence difficult to collect, which in turn affects the possibility of legal proceedings. This study concludes, through literature review and case analysis, that although Taiwan has made considerable progress in promoting gender equality legislation, some institutional obstacles and deeply entrenched social concepts still severely restrict the actual implementation of the law, preventing many victims from truly obtaining the protection they deserve. Research has found that more resources must be invested in the effective prevention and combating of sexual harassment, especially in forensic evidence collection and legal support. The current complaint process should also be simplified to make it easier for victims to seek help.
