Abstract

The chapter analyses the role the Russian Orthodox Church plays in Russian legal system. Formally, the Church is equal with other religious denominations, is divided from the State and its law, is prohibited to intervene into politics. But the reality is far more complex. From the Perestroika on, the Church began to accrue not only its material riches, but also its political weight. The Orthodoxy became one of the powerful sources of political legitimation in Russia, and the Church did not fail to use this in order to win more privileges. One of such privileges is the de facto power of the Church to shape the official ideology. State ideology is formally prohibited by the Constitution. The Church readily filled in this gap, offering its conservative ideology instead. This ideology increasingly ousted the liberal ideals enshrined in the Constitution, and placed its conservative ideals instead as a kind of ‘deep Constitution’. The chapter examines this development.
