Abstract

Adjudicators have become a prodigious force in international law, shaping our understanding of how modern international law is shaped and enforced. The book enhances and refines our understanding of adjudicators as actors of international law by analysing the legal reasoning of adjudicators on the centripetal forces of international law in international economic dispute resolution. Since the turn of the 21st century, defragmentation efforts have placed a focus on adjudicators to create a workable system of international law and reduce normative conflicts. This book asks how adjudicators are playing this role in practice. Based on one of the most comprehensive and systematic empirical and doctrinal studies of international trade and investment adjudication, this book asks how adjudicators have actually approached the dilemma of the coherence and systemic order of international law. The book provides a new and meaningful contribution to the study of the interplay between international economic law and broader international law, by presenting a synthesis of recent research and valuable empirical work. on the existential challenges faced by adjudicators and what tools are available to them to balancing the different factors and conceptions of legitimacy. The research produces new and surprising conclusions for the functioning of international law, its courts and tribunals and the future legitimacy of international economic adjudication.
