Abstract

The legal relationship between Switzerland and the United Kingdom (UK) was essentially based on the contractual relationship between Switzerland and the EU until the UK left the European Union (EU). In view of the fact that the basis for mutual economic relations would cease to exist, the two states had to develop a strategy. Switzerland and the UK agreed that they wanted to continue and expand the existing relations bilaterally. Switzerland developed the so-called “Mind the Gap Strategy” for this purpose. This involved transferring the previous (trade) agreements between Switzerland and the EU into the bilateral relationship in a pragmatic manner and by means of a referral technique. In a further step, the two countries are now in the process of expanding the mutual relationship to include new areas, e.g., in the area of financial services. Furthermore, the body of law taken over from the Switzerland-EU relationship is planned to be transferred into a new, modern trade agreement.
