Abstract

The first chapter of A Legal Theory of Transformative Environmental Constitutionalism offers a Global South context and justification for radical judicial responses to environmental governance challenges so as to develop law for the Anthropocene. The chapter reflects on poverty and inequality in South Africa as giving rise to patterns of disadvantage, marginalisation, and vulnerability, as is the case elsewhere in the Global South. These wicked problems warrant ongoing critical reflection on the implementation of constitutionalism in the adjudication of environmental law disputes. They are viewed as issues of intersecting social, environmental, and climate (in)justice. These forms of (in)justice are conceptualised, and the bookâs focus on the role of the judiciary in responding to myriad intersecting social, environmental, and climate injustices in the Anthropocene is discussed. The chapter explains the bookâs reformist methodology, and the socio-ecological systems perspective adopted throughout. Lastly, the structure of the book is outlined.
