This book is derived from my J.S.D thesis written at the University of the Pacific, McGeorge School of Law. I feel privileged to take this opportunity to express my gratitude to Professor Jarrod Wong, my supervisor, for his intellectual guidance, encouragement, and cooperation throughout my study. His invaluable comments and suggestions on the draft chapters helped improve the quality of my thesis.
