Abstract

The fifth chapter of A Legal Theory of Transformative Environmental Constitutionalism illustrates the practical value of a legal theory of transformative environmental constitutionalism through an examination of struggles for social, environmental, and climate justice that have given rise to three landmark judgments in South Africa: Earthlife, VEJA, and Gongqose SCA. The environmental law disputes giving rise to the judgments represented an opportunity for the courts, as part of South Africa’s project of transformative constitutionalism, to transform environmental governance in the public interest in a manner responsive to the socio-ecological impacts of the Anthropocene. The chapter acknowledges that favourable outcomes in these disputes advanced South Africa’s project of transformative constitutionalism and developed, in some ways, law for the Anthropocene. These outcomes notwithstanding, the chapter critically evaluates the manner in which environmental constitutionalism was implemented by the courts with reference to the theory of transformative environmental constitutionalism unpacked in chapter 4. To the extent that the courts did not apply a legal theory transformative environmental constitutionalism, the chapter explains the value of doing so as part of the development of law for the Anthropocene.
