The European Union is in the process of finalising its regulation on genetically modified crops, although its success is still uncertain. The process of drafting the regulation has already passed two important milestones. The first was the preparation of a draft regulation by the European Commission (EC). After an intensive consultation process and following the mandate of the Consilium (2019), a draft regulation has been presented which proposes that plants obtained through certain new genomic techniques - which scientifically give rise to GMOs - should be subject to a different regulatory regime than GMOs under Directive 2001/18 EC. In February 2002, the European Parliament, by a narrow majority, accepted the general terms of this proposal, albeit with relevant amendments. In terms of the legislative process, the next step is to negotiate the text in the Council. Only if a majority is reached in the Council, which does not seem easy at this stage, will a trialogue process take place between the EC, the Parliament and the Council to discuss proposed amendments and finally adopt a new legal framework. The possibility of using NGT-derived plants in organic farming and, if not, the necessary regulatory adjustments to allow the coexistence of both groups have been discussed at some points in the regulatory deliberations. However, the issue has come to the fore following a series of amendments tabled by MEPs to the Commission’s proposal. This paper takes a critical look at this issue.
