Abstract

Against the backdrop of debates surrounding the Sharia councils and Muslim marriage registration I have sought in this paper to identify and consider the role of some of the key actors that are involved in celebrating and terminating marriages for Muslims in Britain. I argue that for current debates to move forward, it is important to take a step back and consider the various actors that are involved in different stages of Muslim marriage and divorce from the matchmaking process, the religious marriage and its registration, to cases of matrimonial disputes, and potentially divorce. The insights I present in this article draw on the existing literature as well as findings from new empirical research where I examined Muslim practices in contracting Islamic marriages and pursuing Islamic divorce. The study in question involved interviews with British Muslims including Muslim women, Imams, Muftis, Sharia council scholars and other professionals such as solicitors and civil society organisations whose work ties in one way or another with Muslim marriage and divorce practices. The findings show that family and community members, state legal services and civil society actors, as well as faith leaders such as Imams and scholars are key actors that are involved in and may influence decision-making about marriage and divorce for many Muslims. Understanding the roles and contributions such actors make is essential to advancing debates about Muslim matrimonial practices including marriage registration and faith-based divorce mechanisms.
