Abstract

The vulnerability of children is a major reason why they are accorded special care and protection, with their best interests being a guiding criterion for undertaking actions on their behalf. One of the basic principles in children’s rights, and with reference to the African Charter on the Rights and Welfare of the Child (African Children’s Charter), is the deliberate avoidance of the dichotomy between civil and political rights and socio-economic rights. This is of particular significance for children’s rights in the African context given the low levels of socio-economic development relative to other world regions – with a significant impact on the proper growth and development of the African child. Article 5 of the African Children’s Charter does not only provide for the right to life but for the rights to survival, protection, and development as well. This is based on a clear understanding that the right to life cannot subsist alone without the provision of elements that ensure the child can live, survive, and thrive to the highest possible levels. Nonetheless, the implementation of socio-economic rights for children remains a challenge across the African continent and demands urgent action.
